Terms of service

These Terms of Service (the “Agreement”) constitute a public offer under the laws of the Republic of Estonia and the European Union. By placing an order on the Varvikas.Shop website (the “Site”), you confirm that you have read and accepted these Terms.

2. Scope and parties

2.1. This Agreement governs remote retail sales between the Seller and:

  • individual consumers (B2C) purchasing for personal, family, or household use;
  • business customers (B2B) under a public offer and/or pro forma invoice.

2.2. Orders may be placed by persons over 18. Those under 18 may order with parental/guardian consent.

2.3. These Terms apply to orders placed directly through the Site. If you purchase our products via marketplaces (e.g. Amazon or Allegro), the platform’s terms will also apply to part of the process.

3. Product information and pricing

3.1. Product descriptions. Product pages include name, SKU, key features (size, materials, contents), difficulty level (if applicable), as well as images and/or videos. Actual colors/shades may differ slightly due to screen settings; this is not considered a defect.

3.2. Contents. The product page specifies what is included in the set. If consumables are part of the set (e.g. paints, rhinestones, glue), we provide sufficient amounts for standard use as per the instructions.

3.3. Prices, currency, and taxes. All prices on the Site are in euros (€), inclusive of VAT. The final order total consists of the product price plus shipping (if applicable).

3.4. Shipping cost. The shipping cost depends on country/method and is shown at checkout after entering country, city, and postal code. Without a postal code, the Shopify platform cannot calculate shipping correctly.

3.5. Promotions. Discounted/promotional prices and special offers are valid during the specified period and/or while supplies last. Conditions are displayed alongside the product or in the promotion rules.

3.6. Stock availability. Stock status is shown on the product page and may update automatically. If out of stock, we will indicate expected restock timing or offer an alternative/refund.

3.7. Errors. In the case of an obvious technical error (e.g. incorrect price/description), the Seller may cancel the order with a full refund. Such cases are rare and do not limit your consumer rights.

4. Order process (step by step)

  1. Select product. Add items to your cart and review the list.
  2. Enter details. Fill in required fields: name, e-mail, phone, billing/delivery address, country, and postal code — to display accurate shipping and total cost.
  3. Choose delivery. Select a carrier/method (parcel locker / pick-up point / courier).
  4. Choose payment. Select a suitable method (see Section 6).
  5. Review & consent. Review items, address, and total. Confirm acceptance of these Terms and the Privacy Policy. Adjust cookie consents if needed.
  6. Payment. Complete payment via a secure provider. We do not store full card details.
  7. Order confirmation. A confirmation e-mail will be sent. The sales contract is deemed concluded once payment is successful.
  8. Packing & dispatch. Orders placed before 12:00 (EET/EEST) are typically handed to the carrier the same day; orders placed after 12:00 are shipped the next business day. Weekend/holiday orders are processed on the next business day.
  9. Tracking. Once dispatched, the carrier will send a tracking number directly to your e-mail and/or by SMS. If not received, check Spam/Promotions or contact us for help.

5. Shipping and risk

5.1. Delivery areas: Estonia, Latvia, Lithuania, Finland, Germany. Other EU countries by agreement.

5.2. Carriers: Omniva / DPD / DHL (depending on destination and method).

5.3. Delivery times vary by destination, method, and carrier load. Unless otherwise agreed, delivery will be made without undue delay, and by default within 30 days from contract conclusion.

5.4. Risk of accidental loss/damage passes to the Customer upon actual receipt by the Customer or their designated recipient. If visible damage is present, document it upon receipt (report/photo) and contact us within 48 hours — we will assist.

5.5. Unclaimed shipments. If returned as unclaimed/undeliverable due to reasons outside the Seller’s control (incorrect address, expired storage, etc.), the options are: (a) reship at Customer’s expense (actual carrier costs); or (b) refund of product price minus actual outbound and return shipping costs. If caused by the Seller, all costs are covered by the Seller.

6. Payment

6.1. Orders can be securely paid using methods provided by Maksekeskus AS:

  • Estonia: Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay, Citadele;
  • Latvia: Swedbank, SEB, Citadele, Luminor;
  • Lithuania: Swedbank, SEB, Luminor, Šiaulių Bankas;
  • Finland: Aktia, Ålandsbanken, Danske, Handelsbanken, Nordea, Oma Säästöpankki, OP, POP Pankki, S-Pankki, Säästopankki;
  • Bank cards: Visa / MasterCard;
  • Online systems: Google Pay, Apple Pay, PayPal.

6.2. NB! When paying via bank link, confirm the order and then click “Return to merchant”.

6.3. Personal data required for payment is transferred to authorized processor Maksekeskus AS. The contract takes effect once the payment amount is credited to the Seller’s bank account.

6.4. Purchase confirmation (receipt/invoice) is sent electronically. For B2B orders, invoices can be issued.

7. Right of withdrawal (B2C customers)

7.1. You have the right to withdraw from the distance sales contract within 14 calendar days of receiving the goods, without giving any reason.

7.2. Conditions for withdrawal, packaging requirements, exceptions, and refund timelines are detailed in the Refund Policy.

8. Conformity guarantee and quality claims

8.1. All products include a statutory conformity guarantee — 2 years for B2C customers.

8.2. Claim process and remedies (repair, replacement, price reduction, refund) are detailed in the Refund Policy.

8.3. For B2B customers, terms may differ and are specified in the invoice/contract.

9. Completeness guarantee and missing parts

9.1. We check each set for completeness. If parts are missing/lost/damaged during shipping, we will supply the missing parts free of charge.

9.2. A missing parts request does not affect your right to exchange/return under warranties and/or withdrawal rights.

10. Cancellations before dispatch

10.1. If you change your mind before the order is handed to the carrier, contact us — we will cancel the order and issue a full refund.

10.2. Cancellations after dispatch are handled under Section 7 and the Refund Policy.

11. Limitation of liability

11.1. The Seller is not liable for temporary Site interruptions, carrier delays, or minor color/texture differences between product images and the actual item due to device settings. This does not affect your statutory rights.

11.2. For B2B customers, Seller’s liability is limited to direct damages actually incurred, up to the amount paid under the relevant order; lost profits are not compensated unless expressly agreed. This limitation does not apply in cases of intent or gross negligence.

12. Personal data and communications

12.1. Personal data is processed in accordance with our Privacy Policy.

12.2. Order-related notifications are sent as part of contract performance. Marketing messages are sent only with your consent or under “soft opt-in” with the right to opt out.

13. Governing law and dispute resolution

13.1. These Terms are governed by Estonian law, with EU mandatory provisions applying.

13.2. Claims should be submitted to info@varvikas.com.

13.3. For B2C customers, disputes may be resolved out of court through the Estonian Consumer Disputes Committee.

13.4. For B2B customers, disputes are subject to Estonian courts at the Seller’s place of registration.

14. Language and precedence

14.1. This Agreement is drafted in English. Translations are provided for convenience; in case of discrepancies, the Estonian version prevails.

15. Amendments

15.1. We may update these Terms from time to time. The current version is always available on this page and applies to orders placed after publication.
